1. GENERAL PROVISIONS

1.1 Scope of Application

These Terms and Conditions (“Terms”) govern the use of the AI-powered chat service (“Service”) provided by BGR Central Europe Kft. (“Company”, “we”, “us”, “our”). By accessing or using our Service, you (“User”, “you”, “your”) agree to be bound by these Terms.

1.2 Service Description

Our Service provides an AI-powered chat platform where Users can interact with various AI characters. Access to AI characters requires the purchase and consumption of digital tokens (“Tokens”).

1.3 Acceptance of Terms

By creating an account, purchasing Tokens, or using the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms and all applicable laws and regulations.

2. USER ACCOUNTS AND ELIGIBILITY

2.1 Account Registration

To use the Service, you must create an account by providing accurate and complete information. You are responsible for maintaining the confidentiality of your account credentials.

2.2 Eligibility

You must be at least 18 years old to use the Service. By using the Service, you represent and warrant that you meet this age requirement.

2.3 Account Responsibility

You are solely responsible for all activities that occur under your account. You must notify us immediately of any unauthorized use of your account.

3. TOKEN SYSTEM

3.1 Token Purchase

Users can purchase Tokens through our platform using accepted payment methods. Different Token packages will be available for purchase at varying prices.

3.2 Token Usage

Each AI character requires a specific number of Tokens to initiate and maintain conversations
Token requirements may vary between different AI characters
Tokens are consumed based on usage and character interaction complexity
Token balance and usage history are tracked in your account

3.3 Token Validity

Purchased Tokens do not expire unless otherwise specified. Tokens are non-transferable between accounts.

4. PAYMENT AND BILLING

4.1 Payment Methods

We accept various payment methods as displayed during the checkout process. All payments must be made in advance.

4.2 Pricing

Token package prices are displayed in EUR and include applicable VAT. Prices may be subject to change with prior notice.

4.3 Payment Processing

Payments are processed securely through third-party payment processors. We do not store your payment card information.

5. REFUND POLICY

5.1 No Refund Policy

Generally, all Token purchases are final and non-refundable.

5.2 Exception for Unused Tokens

Refunds may be considered only for unused Tokens under the following conditions:

Tokens have not been consumed or used for any AI character interactions
Refund request is made within 14 days of purchase
Technical issues prevented the use of purchased Tokens due to Service malfunction

5.3 Refund Process

Refund requests must be submitted through our customer support system with detailed reasoning. We reserve the right to approve or deny refund requests at our sole discretion.

6. SERVICE AVAILABILITY AND MODIFICATIONS

6.1 Service Availability

We strive to maintain Service availability but do not guarantee uninterrupted access. The Service may be temporarily unavailable due to maintenance, updates, or technical issues.

6.2 Service Modifications

We reserve the right to modify, suspend, or discontinue the Service or any part thereof at any time with reasonable notice.

6.3 AI Character Updates

AI characters, their capabilities, and Token requirements may be updated or modified. We will provide notice of significant changes affecting Token consumption rates.

7. USER CONDUCT AND PROHIBITED ACTIVITIES

7.1 Acceptable Use

Users must use the Service in compliance with applicable laws and these Terms. Users are responsible for all content they input into the AI chat system.

7.2 Prohibited Activities

You may not:

Use the Service for illegal, harmful, or offensive purposes
Attempt to reverse engineer, hack, or compromise the Service
Share account credentials with third parties
Use automated systems to interact with the Service without authorization
Violate intellectual property rights of others

7.3 Content Guidelines

Users must not input content that is illegal, defamatory, harassing, or violates third-party rights.

7.4 Reporting Obligations

If you encounter content or behavior that may be ethically or legally problematic, you are encouraged to report it through our reporting system. We take such reports seriously and will investigate appropriately.

7.5 Age Restriction and Adult Content Warning

18+ SERVICE ONLY: This Service is intended for users 18 years of age and older. The platform may contain adult content (NSFW – Not Safe For Work). By using the Service, you confirm you are of legal age and consent to potentially encountering such content.

8. AI SERVICE DISCLAIMERS AND LIMITATIONS

8.1 Artificial Intelligence Nature

IMPORTANT: All characters on our platform are artificial intelligence entities and NOT REAL PEOPLE. AI characters are computer programs designed to simulate conversation and do not represent actual human beings.

8.2 AI Response Limitations

AI responses are generated by algorithms and may not always be accurate, appropriate, or reliable
AI characters do not provide professional advice (medical, legal, financial, etc.)
Users should not rely on AI responses for important life decisions
AI may occasionally produce unexpected or inappropriate responses despite our safeguards

8.3 No Endorsement of AI Content

AI-generated responses do not reflect the views, opinions, or beliefs of BGR Central Europe Kft. We do not endorse or take responsibility for AI-generated content.

8.4 Character Content Control

Our AI characters are regulated and designed to provide appropriate responses within their defined parameters. Characters will not provide information outside their intended scope or purpose.

9. DATA RETENTION AND CHAT SESSIONS

9.1 Chat Session Data

Chat conversations are stored for 24 hours maximum
After 24 hours, chat data is automatically deleted from our servers
Users can manually delete their chat sessions at any time through their account settings

9.2 Data Deletion

Users have full control over their chat history and can delete conversations immediately if desired. Once deleted, chat data cannot be recovered.

9.3 Data Processing Purpose

Chat data is temporarily retained only to:

Maintain conversation continuity during active sessions
Provide technical support if requested
Ensure service quality and safety

10. INTELLECTUAL PROPERTY

8.1 Service Content

All AI characters, responses, and Service content are proprietary to the Company and protected by intellectual property laws.

8.2 User Content

You retain ownership of content you input into the Service but grant us necessary licenses to provide the Service.

10.3 Restrictions

Users may not reproduce, distribute, or create derivative works from Service content without explicit permission.

10.4 Deepfake and Impersonation Prohibition

While users cannot generate custom characters on our platform, any attempt to use the Service to create, simulate, or impersonate real individuals (including public figures, private persons, or deceased individuals) is strictly prohibited.

11. CONTENT MODERATION AND SAFETY

11.1 Content Monitoring

We employ automated and manual content moderation systems to maintain a safe environment. However, we cannot guarantee that all inappropriate content will be detected or prevented.

11.2 Reporting System

Users can report concerning content, behavior, or technical issues through our reporting system. We investigate all reports and take appropriate action.

11.3 Account Actions

We reserve the right to warn, suspend, or terminate accounts that violate these Terms or engage in harmful behavior.

11.4 Legal Compliance

We cooperate with law enforcement and regulatory authorities when required by law or when we believe there is imminent danger to public safety.

12. LIMITATION OF LIABILITY

12.1 Service Disclaimer

The Service is provided “as is” without warranties of any kind. We do not guarantee the accuracy, reliability, or availability of AI responses.

12.2 AI Content Disclaimer

We disclaim all responsibility for AI-generated content, responses, or advice. Users interact with AI characters at their own risk and discretion.

12.3 Liability Limitation

To the maximum extent permitted by law, our liability is limited to the amount paid by you for Tokens in the preceding 12 months.

12.4 Consequential Damages

We shall not be liable for any indirect, incidental, special, or consequential damages arising from Service use.

13. DATA PROTECTION AND PRIVACY

13.1 Data Processing

Personal data processing is governed by our separate Privacy Policy, which complies with applicable data protection regulations including GDPR.

13.2 Chat Data

Conversations with AI characters are temporarily stored as described in Section 9 (Data Retention and Chat Sessions).

14. TERMINATION

14.1 User Termination

You may terminate your account at any time. Unused Tokens may be subject to our refund policy terms.

14.2 Company Termination

We may terminate or suspend accounts for Terms violations or other legitimate reasons with appropriate notice.

14.3 Effect of Termination

Upon termination, access to the Service ceases, and unused Tokens may be forfeited unless eligible for refund under our policy.

15. GOVERNING LAW AND DISPUTE RESOLUTION

15.1 Governing Law

These Terms are governed by Hungarian law.

15.2 Jurisdiction

Any disputes shall be resolved by the competent courts of Budapest, Hungary.

15.3 EU Consumer Rights

EU consumers retain their statutory rights under applicable consumer protection legislation.

16. MISCELLANEOUS

16.1 Terms Updates

We may update these Terms with reasonable notice. Continued use constitutes acceptance of updated Terms.

16.2 Severability

If any provision is deemed invalid, the remaining provisions remain in full effect.
